Terms and Conditions
1. Utilities & underground lines: Proscape L.L.C.’s work, as outlined, will not proceed until all on-site utilities have been properly located and clearly marked. Proscape L.L.C. will not be held responsible for damage to any unforeseen or underground supply lines, including utilities, cable, irrigation, and invisible fence.
2. Payment: Payment terms, including any required deposit and the schedule of payments, are as specified in the accepted / initialed proposal or agreement for each project.
3. Plant substitutions: Proscape reserves the right to make necessary substitutions with “like species” where the plants listed are not available.
4. Plant guarantee: All plant material installed by Proscape L.L.C. is guaranteed for one (1) year from the time of installation and does not include transplanted materials. All replacements are guaranteed to be replaced once with plants of the same type and size as originally installed. Additional excluded plant material includes anything planted under overhangs, in raised planters, and plants not receiving irrigation or lost due to an act of God.
5. Brick paver guarantee: Brick pavers carry a workmanship guarantee for two (2) years from the date of completion.
6. Grading: Grading is based on plus or minus one inch (± 1″) from the beginning subgrade, which is provided by others.
7. Concealed contingencies: All prices are subject to additional charges for any “concealed contingencies” that may delay production on projects — such as rock, debris, or poor drainage situations — that are not readily apparent during the estimation process. The Customer will be notified immediately in the event of any such condition, together with any additional pricing.
